9205.10 brass-wind instruments. US 8-digit and 10-digit statistical breakouts differentiate by instrument type: 9205.10.0020 trumpets, cornets, and flugelhorns; 9205.10.0040 trombones; 9205.10.0060 French horns; 9205.10.0080 tubas, sousaphones, and other low brass. 9205.90 other wind instruments and parts. Includes woodwinds (clarinets, saxophones, flutes) under separate breakouts, plus 9205.90.20 for parts and accessories of wind instruments generally. The Fed Reg 2026-15961 proposal targets 9205.90 parts where the parts contain a material share of copper alloy content (valve pistons, valve casings, tuning slides, mouthpieces). Scenario B: no affidavit, default full invoice 232.

Section 232 at 50 percent on full invoice: 100,000 x 0.50 = 50,000 USD.

Total post-inclusion duty: 2,900 + 50,000 + 7,500 + 12,500 + 634.62 + 125 = 73,660 USD (74 percent effective rate on CIF).

Delta of Scenario A over current: 34,000 USD on 100k CIF, or 34 percent effective rate increase.

Delta of Scenario B over current: 50,000 USD, or 50 percent effective rate increase.

For a school district buying 200 trumpets at 500 USD landed each in the current stack (100k order), the post-inclusion price passes through to something like 750 to 900 USD per instrument depending on affidavit posture. That is a real budget hit for K-12 music programs already stretched.

Comment framing angles for music-industry importers

Federal Register 2026-15961 is genuinely on the fence for musical instruments. Section 232 requires that the article at issue impair national security. Trumpets and trombones are not defense-critical. Comment framing angles that have moved BIS in past comment windows.

Angle 1: national-security nexus challenge. Brass-wind musical instruments have no defense application. The DoD does not stockpile trumpets or tubas as strategic materiel. Military bands buy through GSA at commercial market rates. Argue that the statutory basis (19 USC 1862 national security determination) is not met for consumer musical instruments and that BIS should exclude 9205.10 from the derivative annex on that ground alone.
