Heading 8501 structure

HTS 8501 covers electric motors and generators (excluding generating sets). Subheadings split by motor type and rated output power:

  • 8501.10: motors of output not exceeding 37.5 W. Small motors for clocks, fans, appliances.
  • 8501.20: universal AC/DC motors of an output exceeding 37.5 W. Power tools, vacuum cleaners.
  • 8501.31 to 8501.34: DC motors by power band.
  • 8501.40: other AC single-phase motors. Power band split into 8501.40.20 (under 75 W), 8501.40.40 (75 W to 750 W), 8501.40.60 (over 750 W).
  • 8501.51: AC multi-phase motors of an output not exceeding 750 W.

PMSM vs induction vs reluctance

The motor topology (PMSM, AC induction, switched reluctance) does not change the 8501.53 subheading. All AC multi-phase motors over 75 kW classify together.

The motor type matters for downstream USMCA qualification because the rare earth magnets in a PMSM are themselves a critical minerals consideration. AC induction motors avoid the rare earth issue. Switched reluctance motors have small windings.

Worked example: Chinese PMSM EV traction motor

Effective rate 10.3 percent. KORUS waives the MFN duty but does NOT carve out Section 122, so Korean traction motors still pay the 15 percent surcharge. Net of duty difference (51 percent on Chinese vs 15.35 percent on Korean), Korean PMSM landed still wins comfortably against Chinese, but the gap is the absence of the Section 301 List 1 layer plus the (already-zero) MFN, not a Section 122 carve-out.

Worked example: Mexican-assembled traction motor

A Mexican Tier-1 supplier assembles 8501.53 traction motors using Japanese-origin neodymium magnets, Chinese copper winding wire, German bearings, and Mexican labor. Unit cost 1,250 USD.

Effective rate 4.35 percent. Mexico-USMCA framework suppresses Section 122 even without per-shipment USMCA qualification. The Mexican-assembled motor lands at 4.35 percent, compared to 51 percent for Chinese and 0.35 percent for Korean.

The strategic implication for EV manufacturers: Korean PMSM is the cheapest landed but supply is constrained. Mexican-assembled is a viable second source and is materially cheaper than direct Chinese. Direct Chinese is uncompetitive on landed cost basis even at a 30 percent FOB price discount.

USMCA chapter 87 advanced parts framework

EV traction motors fall into the chapter 87 advanced-parts category under the 2025 USMCA Appendix update. The vehicle-level RVC of 75 percent applies if the motor is being incorporated into a USMCA-qualifying vehicle. Vehicle assemblers count the motor's RVC into the vehicle's total RVC calculation.

For a Tier-1 supplier selling the motor as a standalone aftermarket part, the chapter 87 framework does not apply at the shipment level. The chapter 85 rule of origin for 8501.53 governs.

For OEM-bound motors, the vehicle assembler may need the motor producer's BOM origin breakdown to compute the vehicle-level RVC. Provide this to OEMs proactively.

IRA Clean Vehicle Credit implications

The IRA Section 30D Clean Vehicle Credit ($7,500 per qualifying vehicle) requires:

  • Final assembly in North America (vehicle level, not motor level).
  • Critical minerals sourcing: a percentage from USMCA or FTA-partner sources, ramping by year.
  • Battery components: a percentage from North America, ramping by year.

The traction motor itself is not a battery component. However the motor's rare earth magnets (neodymium, dysprosium, praseodymium) are in the critical minerals list. Sourcing those magnets from China disqualifies them; sourcing from Japan or Korea qualifies under FTA-partner status.

A typical PMSM contains roughly 200 to 500 grams of rare earth magnet material per motor. The IRA requirement applies to the value of the critical minerals in the magnet, not the motor as a whole. Producer documentation must trace the magnet feedstock back to the rare earth mining country.

Section 122 status as of June 20 2026

The May 7 2026 Court of International Trade ruling in Oregon v. United States (consolidated with Burlap and Barrel v. United States) struck down the Section 122 proclamation. The Federal Circuit issued an administrative stay on May 12 2026, so CBP is still collecting the duty pending appeal. Importers paying now should preserve protest rights and refund claims in case the government loses on the merits. The underlying Section 122 authority sunsets July 24 2026 under the statutory 150-day ceiling, regardless of the appeal outcome, unless Congress extends or a fresh proclamation restarts the clock.
