We referred the information provided to our laboratory for review. We regret the delay. The subject product, Hexaphenoxycyclotriphosphazene is also known as 2,2,4,4,6,6-hexaphenoxy-1,3,5-triaza-25,45,65- triphosphacyclohexa-1,3,5-triene, CAS No. 1184-10-7. You indicate that it will be imported in bulk powder form and will be used as a fire-retardant additive. You suggest classification in subheading 2942.00.3500, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Other organic compounds: Aromatic or modified aromatic: Other: Other: Other.” We disagree. According to our lab, this compound is an ester of an inorganic acid of a nonmetal. Therefore, it will be classified elsewhere. The applicable subheading for hexaphenoxycyclotriphosphazene will be 2920.90.2000, HTSUS, which provides for “Esters of other inorganic acids of nonmetals (excluding esters of hydrogen halides) and their salts; their halogenated, sulfonated, nitrated or nitrosated derivatives: Other: Aromatic: Other.” The general rate of duty will be 6.5 percent ad valorem. The duties cited above are current as of this ruling’s issuance. Duty rates are provided for your convenience and are subject to change. This ruling does not address the applicability of any additional duties, taxes, fees, exactions and/or other charges, which may apply to the goods discussed herein. This includes, but is not limited to, tariffs and other duties as provided for in Subchapter III to Chapter 99, HTSUS. Thus, for example, in addition to the classification stated above, the merchandise covered by this ruling may also need to be reported with either the Chapter 99 provision under which an additional tariff applies or one of the Chapter 99 provisions covering exceptions to such tariffs. Additionally, we note that the material facts described in the foregoing ruling may be subject to periodic verification by CBP. This ruling is being issued under the provisions of Part 177 of the Customs and Border Protection Regulations (19 C.F.R. 177).
