Mail Code 5055 Woonsocket, Rhode Island 02895 RE: The tariff classification of a seat from China. Dear Mr. Prata: In your letter dated July 23, 2021, you requested a tariff classification ruling. In lieu of samples, illustrative literature and a product description were provided for review. Item 988269 identified as the “Sun & Sky(R) Director Chair with Side Table,” is a portable, folding outdoor chair constructed of a steel metal frame. Affixed to the metal frame is a polyester textile seat base and backrest. A collapsible medium density fiberboard flip-up side table with cup holder insert is affixed to the right side seat frame. Plastic foam pads are wrapped around the seat armrests. The chair provides portable seating for outdoor recreation such as camping, hunting, fishing, beach, concerts, and sporting events. The chair dimensions are 30.7” in height, 32” in width, 18.8” in depth, and a weight capacity of 225lbs. Seating is provided for a single individual. You request classification of the subject merchandise in subheading 9401.79.0015, Harmonized Tariff Schedule of the United States, (HTSUS). The applicable subheading for the subject merchandise will be 9401.79.0015, HTSUS, which provides for “Seats (other than those of heading 9402), whether or not convertible into beds, and parts thereof: Other seats, with metal frames: Other: Other: Outdoor: With textile covered cushions or textile seating or backing material: Other.” The rate of duty will be free. Section 301 Trade Remedy Pursuant to U.S. Note 20 to Subchapter III, Chapter 99, HTSUS, products of China classified under subheading 9401.79.0015, HTSUS, unless specifically excluded, are subject to an additional 25 percent ad valorem rate of duty. At the time of importation, you must report the Chapter 99 subheading, i.e., 9903.88.04, in addition to subheading 9401.79.0015, HTSUS, listed above. The HTSUS is subject to periodic amendment, so you should exercise reasonable care in monitoring the status of goods covered by the Note cited above and the applicable Chapter 99 subheading.
