The merchandise under consideration is identified as an an automotive shim, Part Number 530404G100. The subject article is a precision, ring-shaped component manufactured from SK5 high-carbon tool steel. It measures approximately 33 mm in inner diameter, 51 mm in outer diameter, and 1.86 mm in thickness. The shim is designed for use in the differential carrier assembly of a motor vehicle. The shim is installed between the drive pinion gear and the inner pinion bearing. Within the differential assembly, it adjusts the mounting depth and relative position of the drive pinion gear in relation to the ring gear. The shim also controls axial clearance and assists in maintaining the proper preload of the inner pinion bearing. These functions promote proper gear engagement and rotational stability within the differential assembly. The applicable subheading for the automotive shim, Part Number 530404G100, will be 8708.50.8900, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Parts and accessories of the motor vehicles of headings 8701 to 8705: Drive-axles with differential, whether or not provided with other transmission components, and non-driving axles; parts thereof: Parts: For vehicles of heading 8703: Other: Other.” The general rate of duty will be 2.5 percent ad valorem. The duties cited above are current as of this ruling’s issuance. Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided at https://hts.usitc.gov/. This ruling does not address the applicability of any additional duties, taxes, fees, exactions and/or other charges, which may apply to the goods discussed herein. This includes, but is not limited to, tariffs and other duties as provided for in Subchapter III to Chapter 99, HTSUS. Thus, for example, in addition to the classification stated above, the merchandise covered by this ruling may also need to be reported with either the Chapter 99 provision under which an additional tariff applies or one of the Chapter 99 provisions covering exceptions to such tariffs.
