The products in question are Hydrapro thermal expansion tanks, models HPTET2 (2 gallon) and HPTET45 (4.5 gallon). The expansion tanks are constructed of a welded steel shell and installed near a water heater to absorb thermally expanded heated water. This allows a place for the heated water to expand out of the water heater and not exert undue pressure within the potable water plumbing system. The expansion tanks consists of two chambers separated by a rubber diaphragm. Water enters on one side of the diaphragm while air is on the other. As water is heated in the water heater tank, the water expands, creating pressure. The hot water then travels to the thermal expansion tank to be temporarily held. This helps alleviate pressure build up in the potable water plumbing system. The water presses on the diaphragm, compressing the air. When water cools and the water pressure drops, the air pressure pushes on the diaphragm, mechanically forcing the water back into the plumbing system to be used. The applicable subheading for the diaphragm expansion tanks, models HPTET2 and HPTET45, will be 8479.89.9597, Harmonized Tariff Schedule of the United States (HTSUS), which provides for machines and mechanical appliances having individual functions, not specified or included elsewhere in this chapter; parts thereof: other machines and mechanical appliances: other: other: other. The general rate of duty will be 2.5 percent ad valorem. The duties cited above are current as of this ruling’s issuance. Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided at https://hts.usitc.gov/. This ruling does not address the applicability of any additional duties, taxes, fees, exactions and/or other charges, which may apply to the goods discussed herein. This includes, but is not limited to, tariffs and other duties as provided for in Subchapter III to Chapter 99, HTSUS. Thus, for example, in addition to the classification stated above, the merchandise covered by this ruling may also need to be reported with either the Chapter 99 provision under which an additional tariff applies or one of the Chapter 99 provisions covering exceptions to such tariffs.
